GOT QUESTIONS?

Frequently Asked Questions

Straightforward answers to the questions we hear most from Sunshine Coast families dealing with Probate, Estate Administration and Wills.

What is Probate?

Probate is a legal document from the Supreme Court that confirms a Will is valid and gives the executor authority to deal with the estate. That includes banks, share registries and super funds.

Do I need Probate if there's no Will?

If there's no Will, you'll usually need to apply for Letters of Administration instead of Probate. This gives someone (usually the next of kin) the legal authority to administer the estate according to Queensland's intestacy rules. We guide you through the entire application.

How long does Probate take in Queensland?

Timeframes vary, but a straightforward Probate application in Queensland typically takes around 6 to 12 weeks once the application is filed, though more complex estates can take longer. We'll keep you updated throughout the process.

Why do I need a Will?

Without a valid Will, Queensland's intestacy laws decide who inherits your estate. That might not match your wishes, and it usually means more stress, delays and cost for your family. A properly drafted Will gives you certainty, and makes things easier for the people you leave behind.
